Understanding Disability Discrimination and Retaliation: A Case Study


Delores Frazier-White's disability discrimination and retaliation claim against David Gee, sheriff of Hillsborough County, Florida, resulted in a challenging legal battle. The district court initially granted summary judgment in favor of Gee, prompting Frazier-White to appeal. Unfortunately, the court of appeals affirmed the district court's decision. In this blog post we will explore how and why that decision was reached and its implications for disability discrimination law.

Background: Request for Extension and Accommodations

To understand the background of this lengthy legal ordeal, Frazier-White's journey began when she suffered a work-related injury in July 2010. Placed on light-duty status, she was subject to limitations outlined in Standard Operating Procedure 213.00, which allows a maximum of 270 days over two years. Three doctors concluded that she could resume work without restrictions. However, she was notified that she had to be fully fit and return to regular duties by April 24, 2011, under the risk of termination.

Aware of her ongoing care needs, Frazier-White requested an extension of her disability accommodations but did not specify a timeframe or suggest accommodations to support her return to work. A due process hearing was then held to assess Frazier-White's fitness for full-duty work. She admitted her inability to estimate when she would be fully capable, leading to her dismissal in June 2011.

It was at this point that Frazier-White filed a lawsuit against David Gee under the Americans with Disabilities Act, citing disability discrimination and retaliation. However, the district court granted summary judgment in Gee's favor, and Frazier-White's appeal was also denied by the court of appeals.

Proving Disability and Qualified Status

To establish her disability discrimination claim, Frazier-White had to prove her disability, her status as a "qualified individual" at the time of termination, and discrimination tied to her disability. 

In the context of disability discrimination, a "qualified individual" refers to a person who meets the essential requirements of a job position and is able to perform the job's duties with or without reasonable accommodation. In order to pursue a disability discrimination claim, Frazier-White had to demonstrate that she met the necessary qualifications for the position she held when she was terminated. This includes showing that she had the skills, experience, education, and other qualifications necessary to perform the job, despite her disability. By establishing herself as a "qualified individual," Frazier-White could strengthen her case by proving that her termination was unjust and based on discrimination related to her disability.

Employer Discretion: Reassignment Obligations and Limitations

A critical aspect of this case revolved around Frazier-White's request for an indefinite extension of light-duty status. The court deemed this request as unreasonable, leading to a significant point of contention. While it is important for individuals with disabilities to receive accommodations, there are limitations to what can be considered reasonable under the law.

Moreover, in their ruling, the court highlighted that Gee, the employer, was not obligated to reassign Frazier-White to a different role. One crucial factor was Frazier-White's failure to specify a particular position or provide enough information about her ability to perform the duties of a vacant job. This lack of clarity and insufficient documentation raised questions about her suitability for reassignment.

Despite the legal complexities, the court acknowledged Gee's adherence to the Americans with Disabilities Act (ADA) by initiating an informal and interactive process in handling Frazier-White's situation. Retaliatory actions were also ruled out as the driving force behind Frazier-White's termination.


Frazier-White's journey highlights the complexities of disability discrimination and retaliation claims. These cases require careful examination of evidence and legal compliance by all parties involved. While the outcome wasn't what Frazier-White hoped for, her story emphasizes the importance of understanding legal obligations, reasonable accommodations, and fostering clear communication between employers and employees facing disability challenges.
