Glacier Northwest Loses Appeal Over Wage Violations at Quarry

Glacier Northwest challenged Washington Labor and Industries' determination that work at its off-site Mats Mats disposal facility was covered by the state's Prevailing Wage Act. The Washington Court of Appeals held that disposal of tunnel spoils was integral to the publicly funded State Route 99 tunnel project, even though Glacier did not contract directly with the state. The court upheld the prevailing-wage determination and rejected Glacier's constitutional and arbitrary-and-capricious arguments.
