Alborn Construction v. Alaska: Court Upholds Public Works Ruling

Alborn Construction challenged Alaska's determination that renovations to a state-leased office building were subject to the state's Little Davis-Bacon Act. The Alaska Supreme Court upheld the agency, finding that the state was directly involved in the lease amendment, specified the improvements, retained substantial control, and effectively funded the work through increased rent. The court also rejected an estoppel argument and held that the entire renovation project was subject to prevailing wage requirements.
