UPS v. Or. OSHA: Dispute Over Conveyor Shaft Safety Standards

OR-OSHA cited UPS over an unguarded projecting conveyor shaft at an Oregon terminal. An administrative law judge vacated the citation, but the Oregon Court of Appeals found OR-OSHA’s interpretation of the applicable federal safety standard plausible and concluded that UPS had knowledge of the protruding shaft. The appellate court reversed and remanded the ALJ decision.
