Solus v. Superior Court: California Supreme Court Rules on OSHA Preemption

After a workplace explosion at a California plastics facility, Solus challenged civil enforcement claims based on alleged occupational-safety violations, arguing that Cal/OSHA provided an exclusive enforcement scheme. The California Supreme Court concluded that the state Unfair Competition Law and Fair Advertising Law could use workplace-safety violations as predicates because the Labor Code did not make Cal/OSHA remedies exclusive. The civil enforcement action was therefore allowed to proceed.
