Sunrez Corp. v. U.S.: Court Rejects Good Faith Breach Claim

Sunrez Corporation entered into an Air Force SBIR contract to develop prototype composite 463L air-cargo pallets and a Draft Technical Data Package. A dispute arose over the scope of the technical data and the government's access to Sunrez's SBIR data rights. The Court of Federal Claims held that the contract required delivery of the Draft TDP during Phase II and found no breach of the implied duty of good faith and fair dealing. Judgment was entered for the United States.
