San Juan Harbor Dredging Challenged in El Puente v. Army Corps

El Puente v. United States Army Corps of Engineers challenged a proposed dredging project in San Juan Harbor, Puerto Rico. Environmental organizations argued that the Army Corps had not adequately considered marine impacts, cumulative effects, environmental justice, and endangered species.

The D.C. Circuit affirmed the district court’s decision in favor of the Corps. The court found that the agency took a sufficient hard look at environmental consequences, reasonably addressed cumulative impacts, conducted an environmental-justice analysis, and coordinated endangered-species review. The decision illustrates the deference courts may give to agency environmental assessments when supported by reasoned analysis and mitigation measures.
