BCFS HHS v. DOL: Court Dismisses Challenge to SCA Jurisdiction

The Western District of Texas dismissed BCFS Health and Human Services’ challenge concerning application of the Service Contract Act to cooperative agreements with the Office of Refugee Resettlement. The court concluded that there was no final agency action and that administrative review had not been exhausted, leaving the court without jurisdiction to decide the substantive SCA issue.
