Strock Case Revives FCA Claims Over SDVOSB Contract Fraud

In United States v. Strock, the government alleged that Strock Contracting and its owner misrepresented service-disabled veteran ownership and control to obtain SDVOSB set-aside contracts. The Second Circuit held that fraudulent eligibility representations made during certification and bidding can support False Claims Act liability when they are connected to later government payments. The appellate court revived the FCA claims and remanded for further proceedings.
