Service Workers v. Philco-Ford: No Private Action Under SCA

Updated: 3 days ago
Miscellaneous Service Workers, Drivers & Helpers, Teamsters Local #427 v. Philco-Ford Corporation examined whether employees could bring a private lawsuit to enforce the Service Contract Act. Former employees alleged that the successor contractor failed to provide required prevailing wages and fringe benefits and also asserted misrepresentation and state-law claims.
The Ninth Circuit affirmed the conclusion that the SCA does not create a private right of action. The court emphasized that the statute provides administrative enforcement mechanisms through the Department of Labor. It also upheld dismissal of the misrepresentation claims for failure to satisfy the required pleading standard and rejected the state-law theory presented. The decision highlights the procedural limits on private SCA enforcement.
