Rotair v. United States: Court Upholds Sole-Source Apache Parts Award to Boeing

Rotair challenged the Defense Logistics Agency’s sole-source procurement of Apache helicopter spare parts from Boeing, arguing that the government mishandled technical-data rights and Rotair’s approved-source status. The Court of Federal Claims found that Rotair had standing but concluded that the government had a rational basis for the Boeing award and that Rotair failed to demonstrate prejudicial violations of procurement rules. The court denied injunctive relief.
