Peabody Midwest Mining Cited for Safety Violation

Peabody Midwest Mining challenged an MSHA citation involving an elevated mine roadway that lacked an adequate berm while a dragline was being moved. The administrative proceedings found that the bench remained a roadway and that the missing berm created a significant safety hazard. The Seventh Circuit upheld the Commission's findings, including the characterization of the violation as significant and substantial and an unwarrantable failure.
