National Shooting Sports Foundation Challenges State Gun Law

The National Shooting Sports Foundation challenged a New Jersey law authorizing actions against members of the gun industry alleged to contribute to a public nuisance. NSSF argued that the statute conflicted with federal law and violated constitutional protections, including due process, First and Second Amendment rights, and the dormant Commerce Clause.

The Third Circuit concluded that NSSF had not established an imminent injury sufficient for Article III standing in its pre-enforcement challenge.
