Metro Tristate challenged a VA medical-transportation contract awarded to an SDVOSB that lacked a West Virginia Public Service Commission carrier authorization. The West Virginia Supreme Court of Appeals held that federal law preempted the state licensing requirement because imposing it would interfere with the VA's federal contracting authority and Congress's SDVOSB preference under 38 U.S.C. § 8127.
