Int’l Dev. Sols. Loses Appeal Over Afghan Tax Reimbursement

International Development Solutions, LLC challenged the denial of more than $36 million in claimed Afghan tax reimbursements arising from a State Department Worldwide Protective Services contract. The Federal Circuit affirmed the Civilian Board of Contract Appeals, concluding that IDS did not establish that it, rather than parent entities ACADEMI LLC and Constellis, actually incurred the tax costs. The decision emphasized that allowable federal contract costs must be properly documented, allocable, and actually incurred by the contractor.
