Indiana Supreme Court Rules on Privacy Rights and Abortion Laws

Members of the Medical Licensing Board of Indiana v. Planned Parenthood Great Northwest examined whether Indiana's constitutional privacy protections limited the state's authority to regulate abortion. The challenge arose after a lower court issued a preliminary injunction against enforcement of the state's abortion restrictions.

The Indiana Supreme Court concluded that the plaintiffs had not shown a sufficient likelihood of success on their constitutional claim. The court therefore dissolved the preliminary injunction and allowed the challenged restrictions to take effect. The decision addressed the relationship between privacy principles, state regulatory authority, and the state's asserted interest in protecting fetal life.
