Environmental Challenges to 2040 Plan Allowed in Minneapolis Case

The Minnesota Supreme Court held that MERA claims were not barred by MEPA exemptions applicable to Minneapolis’s 2040 Comprehensive Plan. The court found allegations concerning stormwater runoff and reduced wildlife habitat sufficient to state an environmental claim and allowed the challenge to proceed.
