The Fifth Circuit reviewed the FTC's Combating Auto Retail Scams (CARS) Rule and held that the FTC failed to follow a required procedural step by not issuing an Advance Notice of Proposed Rulemaking. The court concluded the omission was significant rather than harmless and vacated the rule.
