Court Affirms Dismissal in Lockheed’s F-16 Upgrade Pricing Case

The Federal Circuit affirmed dismissal of Lockheed Martin's challenges to unilateral price determinations under undefinitized contract actions for F-16 upgrades. The court held that the contracting officers' pricing decisions were not government claims because they established contract prices under the agreed definitization process and did not demand relief from Lockheed. Because Lockheed had not first submitted certified contractor claims, the ASBCA lacked jurisdiction.
