Campbellton Rd. v. San Antonio: Sewer Capacity Contract Dispute

Campbellton Road entered into a sewer-service contract with the San Antonio Water System and funded infrastructure improvements in exchange for future capacity and impact-fee credits. Years later, SAWS said no unused capacity remained and that additional upgrades would be required. The Texas Supreme Court held that the contract provided direct services to SAWS because the developer funded infrastructure that became part of SAWS's system, bringing the dispute within the Local Government Contract Claims Act and waiving governmental immunity.
