BTR Enterprises Loses Bid Protest Over VA Contract Eligibility

BTR Enterprises of SC, LLC v. United States examined Service-Disabled Veteran-Owned Small Business verification and eligibility in federal procurement. BTR had been listed as an SDVOSB in the Department of Veterans Affairs database, but the VA’s Center for Verification and Evaluation reviewed its status after identifying inconsistencies in representations concerning ownership, management, and the involvement of non-veterans.
The Court of Federal Claims upheld the government’s position. The decision supported the determination that the owner’s criminal conduct affected the good-character requirement, that he did not independently control day-to-day operations as required, and that the company had failed to accurately disclose relevant non-veteran involvement. The case underscores the importance of truthful representations and independent veteran control in SDVOSB eligibility.
