Adams County and Denver disputed Denver International Airport noise-monitoring obligations under a 1988 Intergovernmental Agreement. The Colorado Court of Appeals upheld the trial court’s finding that the ARTSMAP modeling system did not satisfy the agreement’s requirement for a monitoring system, and it rejected Denver’s statute-of-limitations, waiver, accord-and-satisfaction, laches, and claim-preclusion defenses. The judgment awarding liquidated damages and prejudgment interest was affirmed.
