27-35 Jackson Ave. v. U.S.: Court Upholds Lease Termination After Flood

A sprinkler failure flooded leased federal office space in Queens, New York. The government terminated the lease after determining that the premises remained untenantable. The Court of Federal Claims and Federal Circuit upheld the termination, finding that the lease vested the government with discretion to determine untenantability and that there was insufficient evidence of bad faith. The Federal Circuit affirmed summary judgment for the United States.
