United Aeronautical v. U.S. Air Force: Ninth Circuit Enforces CDA Jurisdiction

United Aeronautical Corporation (UAC) supplied equipment to the United States Air Force under a contract. A dispute arose regarding UAC’s performance obligations and the government’s response to alleged deficiencies. The disagreement centered on whether UAC had met the contract requirements and whether the Air Force’s actions were justified under the terms of the agreement.

Trial Court Proceedings

The case was brought before the United States Court of Federal Claims. UAC argued that the Air Force had improperly withheld payment and wrongfully penalized the company for performance issues. The government countered that UAC failed to meet the standards required under the contract, and that its actions were consistent with its contractual rights. The Court of Federal Claims ruled in favor of the Air Force, finding that UAC had not demonstrated compliance with its contractual obligations.

Appeal to the Federal Circuit

UAC appealed to the United States Court of Appeals for the Federal Circuit. The appeal questioned whether the lower court erred in its interpretation of the contract and whether the Air Force’s actions constituted a breach. The Federal Circuit reviewed the contract language, the factual record, and the trial court’s findings.

The appellate court concluded that the evidence supported the determination that UAC failed to fulfill its obligations under the contract. It held that the Air Force acted within its rights in enforcing the contract terms and withholding payment. The court emphasized that UAC had not provided sufficient proof to establish that it met the required performance standards.

Court’s Ruling

The Federal Circuit affirmed the judgment of the Court of Federal Claims. The ruling upheld the Air Force’s position and confirmed that UAC had not met its contractual requirements.
